Attorney General Mark Shurtleff said Friday at a public forum that the proposed bill by Rep. Stephen Sandstrom targeting illegal immigration “can’t be fixed” entirely to comply with the U.S. Constitution and urged lawmakers to avoid Arizona’s legal difficulties. However, he cautioned, in absence of alternatives, he expected the Sandstrom bill would obtain easy passage.

The Constitution and Supreme Court decisions are clear: Immigration authority is federal. States can complement federal law, but they cannot assume control. Even copying federal law into state law can violate the Supremacy Clause and federal pre-emption.

In court decision after court decision the Federal government is assumed to have the exclusive authority to determine immigration policies and states such as Arizona are said to seek to usurp the powers of Congress to regulate immigration. However this is not true and all courts limiting states in this regard are simply wrong.
